Listen up.. Back in september I was knocked off my scoot by a 53 years of age lady who simply pulled out of a side road in front of me. Its not that she didnt have time to see me., I was only doing 25mph, and yes I was as the witness agreed. She admitted liability at the scene, at the station, in the back of plods car and a witness backed up the fact. Heres the rub!. She was driving on a Provisional License, in the car on her own, with no 'L' plates on the car. Now when plod checks out her background, she had been driving like this for......30 years...yes you read it right. In the back of the car, and this is what the Sargeant told me who came out, he spoke to the lady who stated..."Ive never had anything like this happen to me before, Im usually a good driver!" exact words these. To which the Sarge said.."But madam, you dont have a full driving license!" She never came near me, apologised or even enquired how I was as I lay there with my right Tibia dislocated at the ankle and sticking out through the skin, with the fibula shattered too, thankyou madam, have a nice day. To date I await the court appearance as shes being charged with one down from Dangerous driving...'Driving without due car and attention'. I cannot go into the legallities too much as yet as its all still pending. But can you believe it..30 years, been doing this since she was 23. It beggars belief. Im a bit happier as I have the bike back after much ado, another long story, and its back to mint again. Thought I might have lost the nerve but that soon passed after the first 50 yards. Great to be back in the saddle. If this isnt in the right forum part, please move it for me, cheers.

That would make her insurance invalid as well - hope it didn't affect your claim. It also puts you in a difficult situation re claiming for injuries as you will have to claim off her direct.
I trust she had her car removed and destroyed (legal action under the circumstances).
I am glad you were able to get back on the bike and feel comfortable.

Theres more, she had the car on 'Motorbility', same rules, must have qualified driver with you, the good news is that Motorbility provide Royal Sun Alliance Insurance who whilst not covering her will have to pay for the third party..me  . so I have a legal team employed in recovering all losses and claims for personal injuries, a lengthy time consuming job. They will not admit liability as yet until the outcome of her hearing in court, a formality but one which drags it out. Once we have been I'll post what punishment she was given. Should be interesting for such a long time lawbreaker.

How very strange as motability normally ask for a copy of the license for their insurance records! She will be told to take a test and not drive unattended until just time + a fine of about £250, any more than this (although justified) would surprise me in todays court system. Bob

Get caught with no insurance in my neck of the woods and it's a minimum of £450 + £costs + £15 victim surcharge and at least 6 points on the licence.

Typical british justice, a real crock of s**t. All she got was £220 fine and 9 points. She pleaded guilty to the charges so automatically got a 33% reduction of punishment so avoiding a ban, not bad for wrecking someones ankle. Never even knew it had gone to court, nice one by the Police, kept up to speed were we, yeah right! I was so looking forward to having my say in court, welcomed or not. Bah!!!

Sorted, solicitors are well into the claim but the guilty party insurers would not admit liability till outcome of case, now she has pleaded guilty they have to accept 100% liability, she stated it was entirely her fault, plus an independant witness stated this was indeed the case,it s just the usual delaying tactic. However, at the end of the day money cannot compensate, I would rather have full use returned any day. Im 48, come 68 i'll be crippled with arthritis. Nice.

I knew of a disqualified driver that managed to get hold of a mobility car. He used to let all the local little 'youths' use it. Had to pause there and remember what site I was on before I described them....I have to be polite on this one. If you do have problems regarding this, the MIB should help you. That's what annoys me when the police set up ANPR cameras to check number plates. It doesn't stop people like this driving. What is needed is more traffic police to actually stop vehicles. On a side note, did any body see the article recently regarding one police force that equipped a car with a high view camera to see into lorry cabs to detect offences. They caught drivers doing everything from reading to cooking their lunch !
